Property Woes

 My neighbor started clearing his property about 4 weeks ago on Thursday. I approached him that night and he said my truck might be on his property. I told him it was not and that I owned about 20ft behind my truck and showed him the property line drawing. He said he would not clear any more until he got a survey. Well I came home the next day and he had cleared about another 10ft of property. I had a survey done that Monday and not only was I right, but his fence was about 10ft on my property. He asked me if I wanted him to move the fence and I said of course. I also asked him to replant the 11 trees that he had ripped up or put up a privacy fence. He laughed at me and then started to get loud :mad:. He also cleared some of my neighbors property so he was out there with me. I listened to the guy for a minute or two and then started getting pissed off. I told him to leave my property twice, but all he did was get louder. I then told him to get off my property or he was going to be on his back on my property. He then called the cops on me trying to get me arrested. The Cop was real cool and asked if I threatened him and I said yes and then he asked me again and I said no. He then told me that the guy has no leg to stand on if I take him to court. I called a Lawyer yesterday and told me that my neighbor had criminally trespassed and told me to call the cops. When the cop showed up today he asked me if I wanted to put a warrant out for his arrest or wait until the hearing. I really wanted to repay the favor that he had given me, but all that would do is make things worse. It would not be so bad, but the guy had no remorse for what he had done and acted like it was my fault for not stopping him. I think the only way to do this is court which plain sucks. I can now see his whole yard and before I could not see any of it. :mad:

You won't pay for court costs if he looses. Be sure to include your legal fees in a counter suit, and damage to your property. You've got him by the balls with the survey.

You could send a letter asking him to remove the fence within "X" amount of time and replace trees or face legal action.

That sucks man. There's a guy that I work with that's going through nearly the exact same thing. They are working on building a fence and the guy just built it.. ended up being 50' into my co-workers land... They are in court now. :help:

I had a really nice brick mailbox this summer get run over also. It happened about two hours after I left to go on vacation. The guy stopped by the next day and talked to my neighbor who gave him my number. The guy payed for the hole thing and apologized about 20 times. I wish my neighbor would be the same way.

True, I talked to him last night while he was taking his fence down and he apologized to me for the first time. He asked me what I wanted and I told him the same thing a fence or privacy back with trees. He said he needed to talk to his girlfriend again. I said whatever he needs to do. I have to get a tree appraiser to come over and look at the trees today. Since he trespassed to get to the trees he cut he owes 3x what they are worth. I told him that last night and I thought he was going to SH#@ himself. He then asked to look at the quote for the fence. He told me he did not want to go to court and I said I wouldn't either if I were him. I really think he going to settle up or at least give me some of what I want. I don't want to take him to court either, but he is was giving me no choice. He is my neighbor and I really don't want bad blood between us. When I get deployed again next year I'm not the one that has to deal with him its my wife and she won't need that kind of added stress. Maybe Bert can move down when I'm gone and he can deal with the guy :lol:

If you ever decide on putting up a fence, you may consider paying half or 1/4 on the fence (Since you'll eventually connect to his).

The trees are a definite must, but if you want something that spreads quickly, that makes for great privacy that is cold resisitant check into bamboo.
